Plaintiff has filed a suit for injunction stating that he is in possession of the property bearing No. 65 shown in red colour in the site plan, consisting of one residential house, shops, cattle shed, chabutra etc. situated within lal dora/abadi deh of village Pakhal, Tehsil and District Faridabad. There is a road in the vicinity which is shown in

blue colour in the site plan. Grievance of the petitioner is that the defendants should not make any illegal construction over the property of the plaintiff in any manner whatsoever. Vide order dated 31.3.2011 the Additional District Judge, Faridabad, while deciding the suit of the plaintiff has observed that the respondent departments are widening and strengthening the road. The road was constructed in the year 1956-57 after acquiring the necessary land. If there is any damage caused to the property of the plaintiff, he can claim damages from the defendants. The present revision is against that order.
Mr. N.K.Tomar, Executive Engineer, is present in Court and states that the widening and metaling of the road is being carried out on the existing road and no damage will be caused to the properties on either side of the road while metaling. Counsel for the petitioner is satisfied with the undertaking given by Mr. Tomar.
The civil revision is disposed of with no further
orders.
