Counsel has stated that due to security reasons, the petitioner - defendant Rameshwar could not appear in the Court along with other witnesses. However, vide the impugned order defendants' evidence was closed by order.
In the circumstances, this petition is disposed of with a direction to the defendant – petitioner Rameshwar that he would close his evidence within three months from today, subject to payment of Rs.500/- as costs.
This petition is disposed of without issuing notice to the respondents with a view to impart complete justice to the parties and to save the huge expenses, which may be incurred by the respondents as also in order to avoid unnecessary delay in adjudication of the matter. Still, if dissatisfied, the respondents may move this court for recalling this order.
