Plaintiff No.1-petitioner has assailed the order dated 7.12.2009 passed by the learned Additional Civil Judge (Sr. Division), Guhla by filing the present petition under Article 227 of the Constitution, whereby his application under Section 151 CPC for adducing additional evidence by way of tendering jamabandis for the year 1959-60 to 1979-80 and examine revenue Patwari and Suraj Bhan-Retd Patwari has been partly allowed and partly dismissed i.e he has been permitted to produce the aforesaid jamabandis but refused the examination of two patwaris as the same would amount to De-novo trial.
Learned counsel for the petitioner states that the petitioner does not wish to pursue this case and, therefore, prays for withdrawal of the petition.
Dismissed as withdrawn.
