Petitioner, entered into an agreement to sell dated 26.3.2008 for sale of his agricultural land measuring approximately 3½ acres with respondent Sahil Kumar @ Rs.2.21 crores per acre. It is stated that a sum of Rs.60 lacs as earnest money has been paid by the respondent and the time for registration of sale deed was extended till 29th November 2009. It is further submitted that the respondent could not pay the entire sale consideration as per terms of the extended agreement and therefore the sale deed was not executed. Apprehending interference in his possession the petitioner/plaintiff is said to have filed a suit for permanent injunction.
Prayer in the present revision petition under Article 227 of the Constitution is for directing the trial court to conclude the trial
within a particular time frame.
After arguing for sometime learned counsel seeks
permission to withdraw the petition at this stage.
Ordered accordingly.
