The appellant has moved C.M.No.9873-C of 2010 for disposal of RSA No.4432 of 2001 in terms of compromise (Annexure-CX) effected between the parties. Learned counsel for the parties, after seeking instructions from the parties, who are present in person in Court, state that the parties have effected compromise (Annexure-CX) and, therefore, the appeal be disposed of in terms of the said compromise.
The appeal has, thus, been lawfully compromised. Accordingly, CM No.9873-C of 2010 is allowed and the appeal bearing No.RSA No.4432 of 2001 is disposed of in terms of compromise (Annexure-CX), which shall form part of the judgment and decree sheet.
