This order will dispose of bunch of appeals bearing RFA Nos. 2708, 2730, 2929 and 2963 of 1992 filed by the landowners seeking further enhancement is compensation for the acquired land, as the same are arise out of common acquisition.
Briefly, the facts are that vide notification dated 2.4.1986, issued under Section 4 of the Land Acquisition Act, 1894 (for short, 'the Act'), the State of Haryana acquired land situated within the revenue estate villages Paluwas, Hadbast No. 12, Bhiwani-Lohar, Hadbast No. 22, Tehsil and District Bhiwani for establishing 220 KV Sub-Station at Bhiwani. The Land Acquisition Collector vide award dated 30.9.1986 assessed the market value of the acquired land @ 20,000/- per acre. Dissatisfied with the award of the Collector, the landowners/claimants filed objections. On reference under Section 18 of the Act, the learned court below vide award dated 29.5.1992, determined the market value of the acquired land @ 48,400/- per acre. It is this award which is challenged in the present set of appeals.
Learned counsel for the appellants submitted that the claim of the appellants in the present set of appeals is squarely covered by judgment of this court in RFA No. 2867 of 1992 Ajit Singh Tanwar and others vs State of Haryana, decided on 25.2.2010 whereby the compensation for the acquisition in question was further enhanced to ` 80/- per square yard.
Learned State counsel did not dispute this factual position.
Accordingly, for the reasons stated in Ajit Singh Tanwar's case (supra), the present set of appeals are disposed of in the same terms.
