The land owners are in appeal seeking further enhancement of compensation awarded by the learned court below for the acquired land.

Briefly, the facts are that vide notification dated 28.3.1985, issued under Section 4 of the Land Acquisition Act, 1894 (for short, the Act'), the State of Haryana acquired the land situated in village Gurgaon for development and utilisation as residential and commercial area of Gurgaon. The same was followed by notification dated 15.1.1986 issued under Section 6 of the Act. The Land Acquisition Collector (for short, the Collector') assessed the market value of the acquired land @ 1,05,000/- per acre for chahi land; 85,000/- per acre for Magda land; 65,000/- per acre for Banjar land and 45,000/- per acre for Gair Mumkin kind of land. Aggrieved against the same, the land owners filed objections which were referred to the learned court below, who keeping in view the material placed on record by the parties, determined the fair value of the acquired land @ ` 80/- per square yard.

Learned counsel for the appellants submitted that the claim made by the appellants in the present appeal is squarely covered by the judgment of this court in RFA No. 983 of 1993 –Sewa Singh v. State of Haryana and another, decided on 10.11.2008, whereby the compensation for the acquired land was enhanced to ` 87.50 paise per square yard.

Learned counsel appearing for the State did not dispute the fact that the issue under consideration in the present appeal is squarely covered by the judgment of this court in Sewa Singh's case (supra).

Accordingly, for the reasons recorded in Sewa Singh's case (supra), the present appeal is disposed of in the same terms.
