This order shall dispose of the aforesaid appeals, as the same arise out of common acquisition.
The landowners have filed the aforesaid appeals before this court against the award of the learned court below passed under Section 18 of the Land Acquisition Act, 1894 (for short, 'the Act') seeking enhancement of compensation for the acquired land.
The facts have been extracted from RFA. No. 1729 of 2003.
Briefly, the facts of the case are that the Union Territory, Chandigarh, vide notification dated 3.7.1997 issued under Section 4 of the Act, acquired land of Villages Nizampur Burail and Jhumru, UT Chandigarh, for public purpose. The Land Acquisition Collector assessed the market value of the acquired land at Rs. 5,91,200/- per acre. The landowners feeling dissatisfied with the amount of compensation awarded by the Collector, filed objections, which were referred to the learned Reference Court, who keeping in view the material placed on record by the parties, determined the market value of the land @ Rs. 12,00,000/- per acre. It is this order which is impugned in the present appeal.
Learned counsel for the appellants submitted that the claim of the appellants in the present set of appeals is squarely covered by judgment of this court in RFA No. 727 of 2001 Narinder Singh vs Union Territory, Chandigarh, decided on 4.2.2009, whereby compensation payable to the landowners was further enhanced to Rs. 15,46,450/- per acre.
