The landowners are in appeal before this court against the award of the learned court below passed under Section 18 of the Land Acquisition Act, 1894 (for short, 'the Act') seeking enhancement of compensation for the acquired land.
Briefly, the facts of the case are that the State of Haryana vide notification dated 28.3.1985 issued under Section 4 of the Act, acquired the land situated within the revenue estate of Village Gurgaon, for the development and utilisation thereof as residential and commercial area at Gurgaon. The Land Acquisition Collector vide his award dated 14.1.1988 assessed the market value of the land @ 1,05,000/- per acre for chahi land; 85,000/- per acre for magda land; 65,000/- per acre for banjar land; and 45,000/- per acre for gair mumkin land. Aggrieved against the same, the landowners filed objections which were referred to the learned Additional District Judge, Gurgaon, who keeping in view the material placed on record by the parties, determined the market value of the acquired land @ ` 80/- per square yard. It is this award which is impugned in the present appeal.
Learned counsel for the parties submitted that the claim made by the appellants in the present appeal is squarely covered by the judgment of this court in RFA No. 983 of 1993 Sewa Singh vs State of Haryana and another, decided on 10.11.2008, whereby the compensation for the acquired land was enhanced to ` 87.50 paise per square yard.
Accordingly for the reasons recorded in Sewa Singh 's case (supra), the present appeal is disposed of in the same terms.
