The Union of India has preferred this appeal under Clause X of the Letters Patent challenging judgement dated 12.12.2009 rendered by the learned Single Judge. It has been held that Smt. Tej Kaur a widow of army personnel was entitled to the grant of ordinary family pension as provided under para 219 of the Pension Regulations for the Army. It has come on record that Tej Kaur remarried the younger brought of her deceased husband and as per Regulation 219 she would be entitled to family pension. While allowing the writ petition, the learned Single Judge has placed reliance on various judgements including the one rendered by Hon'ble the Supreme Court, this Court and Delhi High Court. On our asking for any distinguishing feature between the judgements relied upon by the learned Single Judge and the facts of the present case, learned counsel for the appellant has not been able to show us any such component or feature which may impel us to take a view different than the one taken by the
