This appeal filed under Clause X of the Letters Patent is directed against the judgment dated 6.11.2009 rendered in C.W.P. No. 16953 of 2009 passed by the learned Single Judge of this Court. The learned Single Judge has found that for appointment to the post of Field Inspector (Store), minimum one year diploma in computer from a recognized University/ Institution, apart from other qualification was necessary.

The aforesaid finding is based on qualification advertised vide advertisement No. 3 of 2007. The learned Single Judge has rightly found that the certificate issued by the Tata Infotech Limited (Annexure P3) does not satisfy the aforesaid conditions because the Tata Infotech Limited by virtue of agreement dated 11.05.2001 (Annexure P2) entered with the respondent-State has merely permitted for imparting computer education as an optional subject in the Government Educational Institutions (Schools, Colleges, Industrial Training Institutions and Vocational

Education Institutions) for short duration of computer courses. Accordingly, certificate issued by the Tata Infotech Limited, during that training is not equivalent to one year diploma in computer. Further reason given by the learned Single Judge is that the certificate has been issued for participation in the computer training for a duration of 90 and 120 hours. The students, who are studying in Government Education Institutions attended the course as an optional subject and consequently, certificate was issued. Likewise, other certificate issued by the Webs Computer Education has also been found to be answering the required qualification as it is not a diploma course in computer.

After hearing learned counsel for the appellant, we find no legal infirmity in the view taken by the leaned Single Judge. The petitioner did not answer the qualification advertised for the post of Field Inspector (Store). Therefore, he has been rightly found ineligible for consideration for appointment to that post. The appeal is wholly devoid of merit and is, thus, liable to be dismissed.
