The aforesaid appeal was dismissed for non-prosecution on 23.11.2009. Application for restoration thereof was filed on 3.12.2009 and notice was issued to the counsel for the non-applicant for 23.3.2010. Thereafter, the case was adjourned to 8.7.2010, 26.8.2010 and today. However, counsel for the appellant has never appeared. The application for restoration was also allowed in his absence on 8.7.2010.
Accordingly, the appeal is dismissed for non-prosecution.
