Mr. R.D. Sharma, D.A.G., Haryana has been asked to accept notice on behalf of respondents.

Keeping in view the nature of relief claimed and with the consent of learned counsel for the parties, this petition is being disposed of at the motion stage itself.

The petitioner claims to be a sports person having participated in the various wrestling competitions in 50 Kg. Greeco-Roman category. He applied for Sports Gradation Certificate. State of Haryana has issued instructions dated 30.11.1993 to issue Sports Gradation Certificate. Under clause 10 of the aforesaid instructions for issuing Gradation Certificate in Grade-A participation in the lower grade has been made a pre-requisite. It is alleged by the petitioner that since no tournament was held in the lower grade, thus, the petitioner had no occasion to participate. Petitioner has placed reliance upon judgement of this Court dated 10.9.2008 passed in CWP No. 19551 of 2007. He has also served a legal notice (Annexure P-6) in this respect but no decision has been taken thereon till date.

Learned counsel for the petitioner submits that the petitioner would be satisfied, if, respondents are directed to take decision on the legal notice served by the petitioner, referred to above.

In view of the above, this petition is disposed of with a direction to respondent no.2 to take decision on the legal notice served by the petitioner, within a period of three weeks from the date certified copy of this order is served upon the said respondent. Needless to say that in the event the claim of the petitioner is to be rejected, the same shall be by a reasoned and speaking order.
