Present: Mr. NK Malhotra, Advocate, for the petitioner. PERMOD KOHLI, J. (Oral):
I have heard learned counsel for the petitioner at length.
The petitioner is claiming quashment of the order dated 03.09.2010 (Annexure P-5) whereby his claim for arrears of salary on account of retrospective deemed promotion has been denied. Earlier the petitioner had approached the Civil Court by filing a Civil Suit. The said Civil Suit was dismissed by the learned trial Court. However, in appeal, the learned Appellate Court directed the respondents to decide the claim of the petitioner for arrears of salary. In response to the aforesaid direction of the Civil Court, the respondents have passed the impugned order.
At this stage, learned counsel for the petitioner submits that since the claim of the petitioner has been considered pursuant to the direction of the Civil Court, he may be permitted to withdraw the writ petition with liberty to approach the Civil Court.
Prayer is allowed.
Writ petition is dismissed as withdrawn.
