The petitioner seeks a direction for the release of Rs.4800/alongwith interest w.e.f. September, 1987 said to have been illegally recovered from him. He also seeks a mandamus to grant interest on the delayed payment.
The petitioner's case is that a sum of Rs.4800/- was recovered from him towards GPF advance loan, though no such loan was taken by him and as a result thereto, there are missing credit entries in his GPF account causing him financial loss since September, 1987. The petitioner's further grievance is that despite repeated representations including dated 18.4.2009 (Annexure P-9) followed by the reminder in August, 2009

(Annexure P-10), the afore-stated amount has not been refunded to him.
Having heard learned counsel for the petitioner at some length, I deem it appropriate to dispose of this writ petition with a direction to respondent Nos.1 & 2 to consider the petitioner's above mentioned representation and if found correct, refund the afore-stated amount to the petitioner alongwith interest @ 7% per annum as is admissible under the Government Instructions/Policy. The needful shall be done within a period of three months from the date of receiving a certified copy of this order.
