After arguing the case for some time, counsel for the petitioners states that he may be permitted to withdraw this writ petition with liberty to the petitioners to pay the enhanced price as demanded by order dated 22.2.1984 (Annexure P-4) for 1 Standard Acre 4 Units of land.
Counsel for the respondents, however, states that this course of action would have been appropriate if the land in dispute had not been utilized.

In my opinion, admittedly at the time when the writ petition was filed, the petitioners were in possession of the land in dispute and their dis-possession was stayed and, therefore, there would be no question of their further utilizing this land. Consequently, as prayed for by counsel for the petitioners, this writ petition is dismissed as withdrawn with liberty to the petitioners to deposit the amount, as per Annexure P-4, within a period of four weeks from the receipt of a certified copy of this order.
