It has been contended by the petitioners that the municipal authorities had unauthorisedly occupied their land. To say so, reference has been made to the demarcation report dated 15.7.2010, wherein it has been so said. It is prayer of the petitioners that the municipal authorities may either release the land in question or to pay compensation to the petitioners for the land utilized to construct a drain.

Perusal of the record indicates that by stating their grievance, the petitioners have already sent a notice on 19.3.2010 (P6), which is still pending undecided

In view of the factual position mentioned above, especially the contents of the demarcation report, we dispose of this writ petition by issuing directions to the Executive Officer, Municipal Corporation, Yamuna Nagar to decide notice filed by the petitioners. When passing any order, finding given in the demarcation report be kept in mind. It is further made

clear that if the waste water drain has been constructed by the PWD (B&R) Public Health Department, the matter be referred to the said department and then respondent No.2 shall pass an appropriate order. Needful be done within three months from the date of receipt of a copy of this order. If the authorities are satisfied that the land belongs to the petitioners then process to acquire the same be initiated forthwith or compensation be paid to the

petitioners through negotiation.
