The petitioner was tried by Sub Divisional Judicial Magistrate, Abohar, for an offence under Section 304-A IPC with the allegations that on 3.10.1999 at about 8.30 p.m. he drove his tractor in a rash and negligent manner, without blowing any horn and without switching on the lights as a result of which the tractor collided with the scooter driven by Sham Lal upon which Jassa Singh was a pillion rider and in the said accident, both of them had died. Vide judgment and order dated 3.6.2002, the trial Court convicted the petitioner for the said offence and sentenced him to undergo rigorous imprisonment for one year and to pay a fine of Rs.1000/-, and in default thereof, to undergo rigorous imprisonment for one month. As per the affidavit dated 17.2.2010 of Deputy Superintendent, Central Jail, Ferozepur, which has been produced by learned State counsel, the petitioner was released on 15.8.2003 after expiry of his sentence of imprisonment after taking into consideration the Government remission earned by him. He was detained thereafter, on account of non payment of fine, which he paid lateron, and, accordingly, on 18.8.2003 he was released from the jail.
Learned counsel for the petitioner states that after his release from the jail, the petitioner has not contacted him nor he has received any instructions to prosecute the present revision. Therefore, the revision has become infructuous. Disposed of, as such.
