Both the aforementioned petitions have been filed for regular bail under Section 439 of Code of Criminal Procedure in FIR No.47, dated

06.02.2009, under Sections 395/397/412/506/309 IPC, registered at Police Station Sadar, Hansi.

I have heard learned counsel for the parties and have gone through the whole record.

It has been argued by the learned counsel for the petitioners that recovery of truck has already been effected and the same has not been recovered from any of the petitioners – accused. It is further argued that case is at the stage of trial and that co-accused Sandeep @Sonu, Ramesh, Manjeet and Shiv Kumar are already on bail and the case of present petitioners is no different. Further argues that trial of the case will take some time to conclude and no purpose would be served by keeping the petitioners in jail. It is further contended that petitioner – Billu @Balwan is in custody since 06.03.2009 and Mandeep is in custody since 18.02.2009.

These facts have not been disputed by the learned counsel for the State. Trial is not likely to be concluded in near future.

There are no allegations on behalf of the State that petitioners are likely to abscond or that they are likely to dissuade the witnesses from deposing true facts in the Court, if released on bail.

Hence, keeping in view these facts and without expressing any opinion on merits, the instant applications for regular bail filed by Billu @Balwan and Mandeep are allowed.

Bail to the satisfaction of CJM/Duty Magistrate, Hisar.
