Malkit Singh Vs State of Punjab

Petitioner has filed this petition under Section 438 of the Code of Criminal Procedure for grant of anticipatory bail in case FIR No.257 dated 24.12.2009, under Sections 409,420 of Indian Penal Code, Police Station Samrala, District- Ludhiana.

At the time of issuance of notice of motion on 17.2.2010, the following order was passed by this Court :-

"Learned counsel for the petitioner has

submitted that the petitioner has been falsely involved in this case after his retirement. The petitioner had served the society for 23 years and there was no complaint against him during the said period.

In the meantime, in the event of arrest,

the petitioner be admitted to interim bail subject to the satisfaction of the Arresting Officer. He shall abide by the conditions envisaged under Section 438(2) of the Code of Criminal Procedure.”

Learned State Counsel, who is assisted by Sub Inspector Gurbaksh Singh, has submitted that in terms of the above order the petitioner has joined investigation.

Accordingly, without expressing any opinion on the merits of the case, the interim bail granted by this Court on 17.02.2010 is made absolute.

The petition stands disposed of accordingly.
