The present petition filed under Section 439 Cr.P.C. is for grant of regular bail to the petitioner in case FIR No.337 dated 15.9.2008, under Sections 302/201/420/468/471/34 IPC, registered at Police Station Division No.6, Ludhiana.

It has been contended by learned counsel for the petitioner that case of present petitioner is similar to co-accused Harbinder Singh @ Binder Singh and Satnam Singh @ Satti, who have already been granted regular bail by this Court vide order dated 6.8.2009 passed in Crl.M.No.M 17367 of 2009, Annexure P3. It has further been contended that the case is mainly based on extra judicial confession, which is a weak type of evidence and even the dead-body has not been recovered.

On the other hand learned State counsel has stated that car belonging to the deceased was recovered from the present petitioneraccused and, however, registration certificate of the car, sim cards and watch of the deceased was recovered from co-accused. It has also been stated that the car is in the name of the wife of the deceased.

After hearing learned counsel for the parties, I am of the view

that the case of present petitioner is similar to co-accused Harbinder Singh @Binder Singh and Satnam Singh @ Satti. He has been continuing in custody since 24.9.2008 and only one witness has been examined so far. Conclusion of the trial will take some time.

Hence, in view of these facts and without expressing any opinion on the merits of the case, the present petition for regular bail filed by Baljinder Singh @ Gandhi is accepted and the petitioner is directed to be released on bail to the satisfaction of CJM/Duty Magistrate, Ludhiana.
