Parveen Singh and Anr. Vs State of Punjab

This petition has been filed under Section 438 of the Code of Criminal Procedure for grant of anticipatory bail in case FIR No. 57 dated 12.7.2010, under Sections 308, 325, 323, 34 of the Indian Penal Code at Police Station Dyalpura District Bathinda.

While issuing notice of motion, the following order was passed by this Court on 12.11.2010:-

“ Learned counsel for the petitioners has submitted that it is a case of version and cross-version. Petitioner No.1 is suffering from 60% disability and has

Criminal Misc. No.M-33246 of 2010 (O&M) also suffered injuries in the alleged occurrence.

Notice of motion for 13.12.2010.

¶19

In the meantime, in the event of arrest, the petitioners be admitted to interim bail subject to the satisfaction of the Arresting Officer. They shall abide by the conditions envisaged under Section 438 (2) of the Code of Criminal Procedure.”

Learned State counsel, on instructions from SI Avtar Singh, has submitted that the petitioners have joined investigation in terms of the order reproduced above and are not required for further investigation.

Accordingly, without expressing any opinion on the merits of the case, this petition is allowed and the interim bail granted vide order dated 12.11.2010 is made absolute.
