The petitioner seeks regular bail in a case registered against him on 04.8.2004 in which he has been charge-sheeted on 16.1.2006 for the offences under Sections 323, 452, 427, 148 and 149 IPC.
The FIR in the case has been registered on the complaint of Jasveer Singh @ Seera. In the incident that occurred on 03.08.2004, the petitioner is said to have given a blow with the tyre lever on the right foot of Lakhveer Singh, brother of the complainant Jasveer Singh @ Seera. The injury is simple in nature. The father of the petitioner namely Bhagwan Singh, it is stated, is an aged person and suffering from paralysis and he is dependent on the petitioner. Till date, the father of the petitioner is suffering from paralysis. The petitioner had been regularly attending the Court proceedings. However, he did not appear before the learned trial Court on 20.8.2009. Accordingly, non-

bailable warrants were issued on 20.8.2009. Thereafter, the petitioner was declared a proclaimed offender on 19.3.2010. He was arrested on 2.7.2010 and since then he is in custody. It is submitted that the absence of the petitioner is only due to the reason that his father has been suffering from paralysis.
After giving my thoughtful consideration to the matter, it may be noticed that in the incident that occurred on 03.8.2004, the petitioner is said to have given a blow with the tyre lever on the left foot of Lakhveer Singh, brother of the complainant Jasveer Singh @ Seera. The trial in the case is likely to take time.
In the circumstances, the Crl. Misc. petition is allowed and the petitioner on his furnishing personal bond and two sureties to the satisfaction of the learned trial Magistrate shall be admitted to bail. The petitioner shall also file an undertaking that he shall not absent himself from the trial of the case in future except with the prior permission of the Court.
