Prayer under Section 439 Cr.P.C is for grant of regular bail in case FIR No.132 dated 17.3.2010 under Section 364-A IPC, P.S Model Town, Panipat.
As per allegations in the FIR lodged by Jija of Subhash, Subhash and his wife-Suman (petitioner) were missing since 23.11.2009 from their house at Panipat. Complainant had received a mobile call from one Safik, alleged tantrik from the mobile of Subhash demanding ransom of Rs.1/2 lacs for safety of Subhash and the petitioner-Suman.
Learned state counsel, on instructions from ASI Pyare Lal, states that during the investigation of the FIR, it came into evidence that the aforesaid tantrik-Safik was having illicit relations with the petitioner-Suman and both of them had taken Subhash to Haridwar, where on 27.11.2009 after consuming liquor, he was thrown in Ganga. resided at Meerut for three and half months before their arrest.
After arguing for some time, learned counsel for the petitioner
wishes to withdraw the petition at this stage.
