Petitioners have filed this petition under Section 482 of the Code of Criminal Procedure for quashing of the order dated 27.5.2010 passed by the court of Judge, Special Court, NRI Jalandhar and further for directions to respondents to release the passports and to permit them to visit U.K. for a period of four months.

Learned counsel for the petitioners has submitted that the petitioners are Non-Resident Indian. They have to return back to London before 20.7.2010 otherwise they will lose various benefits allowed to them. Petitioners undertake to appear before the trial Court on 27.9.2010, the date fixed for framing of the charge before the said Court. The petitioners had earlier also gone to London and had returned back within the stipulated period.

Learned State counsel, on the other hand, has opposed the petition.

Keeping in view the fact that the petitioners are residing in London and in case they do not return back before 20.7.2010 they will lose all the requisite benefits like Medical Insurance etc, it would be in the interest of justice to allow the petitioners to visit London before the said date. Petitioners have undertaken that they would return back from London prior to date fixed before the trial Court i.e. 27.9.2010.

Accordingly, this petition is allowed. The impugned order (Annexure P-32) dated 27.5.2010 is set aside. The petitioners are allowed to go to London for eight weeks subject to furnishing adequate security to the satisfaction of the trial Court. Petitioners shall also furnish an undertaking that they shall return back from London prior to the date fixed before the trial Court and shall not seek extension for their stay in London.
