Learned counsel for the petitioner has submitted that coaccused Som Pal @ Sonu, who was similarly situated as the petitioner, has been allowed bail by this Court vide order dated 14.5.2010 passed in CRM-M No.11067 of 2010 (Annexure P-3). The petitioner had allegedly suffered an extra judicial confession before Thambu Ram and the said witness had not supported the

prosecution case, while appearing in the witness box.

Learned State counsel, on the other hand, has opposed this petition.

Keeping in view the submissions made by learned counsel for the petitioner, it would be just and expedient to release the petitioner on bail.

Accordingly, without expressing any opinion on the merits of the case, this petition is allowed. The petitioner is ordered to be admitted to bail subject to the satisfaction of Chief Judicial Magistrate, Jind.
