Present revision petition has been filed by the complainant against the judgment and order dated 12.1.2010 whereby the respondents-accused have been acquitted in case bearing FIRNo.128 dated 23.10.2001 under Sections 354, 506 and 120-B IPC registered with P.S. Sadar, Khanna.
Learned counsel very fairly concedes that in view of the amended provisions of Section 372 Cr.PC w.e.f. 31.12.2009, the petitioner prays for return of the revision petition to file an appeal before the appropriate court in terms of the proviso added to Section 372 Cr.PC.
