On receipt of an application from applicant Bhupinder Singh, the matter was ordered to be listed on the judicial side. Notice was issued to the State. In reply filed by the State, it has been averred that a naka was held on the basis of receipt of a secret information. Two cars were seen coming from Ishargarh Village. When the police tried to stop the cars, the drivers of both the cars tried to take a 'U' turn but the passage was blocked by the police. The occupiers of the cars started firing at the police party. The police party was wearing bullet proof jackets and two bullets had hit the bullet proof jacket of Inspector Rajesh Kumar. The police also fired in the air. The accused were arrested and they disclosed their identity. On search of the cars, 75 revolvers, 10 double barrel gun and 30 carbine were recovered. FIR No.169 dated 6.6.2009, under Sections 307/398/401/420/467/468/471/411 of Indian Penal Code (in short 'IPC') and 25 of the Arms Act, 1959 (in short 'Act') was registered at Police Station Sadar Thanesar. investigation, it also transpired that accused had snatched a car from Hoshiarpur and on their statements FIR No.197/09, under Sections 399,402,307 IPC and 25 of the Act was registered in the Police Station Sadar Thanesar. The accused were arrested on 6.6.2009. The news item published in Danik Jagran Newspaper was baseless qua the arrest of the accused on 29.5.2009. Now the challan has been presented and one witness has already been examined in the case. In these circumstances, no further interference by this Court is called for.
