The matter is presently listed for recording of the plaintiff's evidence on 18.05.2010. Learned counsel for the respondent informs that the plaintiff's evidence shall positively be concluded on that date. If he requires assistance of the Court in the form of summonses, it shall be extended to him. However, non-return of the summonses or nonexecution thereof shall not justify a request for a further adjournment. Thereafter, the matter could be adjourned to 30.05.2010 on which date the petitioners – defendants shall conclude their evidence.
On consensual basis, the petition is disposed of with a direction that the learned Trial Court shall dispose of the main suit itself by or on 14.06.2010. Till then, the parties shall observe status quo.
The acknowledgment (of copy of this order) issued by the concerned Judicial Officer shall be forwarded to the Registry of this Court. Learned District Judge shall himself maintain a tab to ensure that the main suit is disposed of by aforementioned date.
