The impugned order in the present case was passed by the learned Court below on May 11, 2009. The petitioner/defendant No.1 is claiming that he is in possession of 5 marlas of land in terms of compromise. Though interim stay protecting the possession of the respondent No.1/plaintiff was granted by learned Court below on 20.4.2007 still the fact remains that the petitioner was not aggrieved against the order as the petition came up for hearing before the Court for the first time on December 4, 2009 when it was adjourned on request of counsel for the petitioner for today.
Considering the aforesaid fact where against the interim injunction granted against the petitioner he was not seriously aggrieved for so long, this Court would not like to interfere at this belated stage.
The revision petition is accordingly dismissed.
