In the present revision petition, order of the appellate authority, whereby it determined Rs.3,400/- per month as mesne profit, has been assailed. The petitioners-landlords have prayed that the rent should have been assessed at Rs.70,000/- per month. Counsel for the petitioners has further submitted that the petitioners pray that the appeal be decided. Counsel for the respondents has no objection thereto.
It is stated that the appeal is fixed before the appellate authority in the month of September, 2010. Counsel for the parties are in agreement that on that day itself, the appeal shall be argued.
In view of this, the appellate authority is directed to decide the appeal within a period of two months from the date of receipt of a certified copy of this order. Since the appeal is ordered to be decided within a stipulated timeframe, this Court shall refrain to determine the mesne profit.
