This is a revision petition, under Article 227 of the constitution of India, against the order dated 2.12.2009 passed by Civil Judge (Jr.Div.) Ludhiana whereby, an application filed by the plaintiff for consolidation of two suits has been dismissed.
Learned Court below has recorded in its order that suit for permanent injunction is now fixed for rebuttal evidence and arguments whereas second suit is fixed for defendant evidence. Both the suits are at different stages and evidence in one of the suit has already been closed. Learned Court below has also offered that if the parties so desire, both the suits can be heard on the same date. I have heard learned counsel for the petitioner but I do not find any error of jurisdiction in the order passed by the Court below. Hence, the revision petition is dismissed.
