M/S Swaran Singh & Sons Are Wale Vs Amritsar Sewa Samiti (Regd.)

Petitioner-tenant was ordered to be evicted in ex-parte proceedings. On the observations made by this Court, that fair play, and balance of equity require that due opportunity be afforded to the respondent, Counsel for the respondent has stated that already the matter is 10 years old. To redress the grievance of the respondent, an observation is made that the Rent Controller should decide the eviction petition within a specified time.

After hearing Counsel for the parties, ex-parte ejectment order dated 19.7.2005 is set aside. Rent Controller is directed to decide the eviction petition within a period of six months after affording three effective opportunities to both the parties to lead their evidence.

Counsel for the respondent has further stated that for causing

delay and sufferings to the respondent, he should be compensated in monetary terms.

The request of the Counsel for the respondent is accepted and costs of Rs.5,000/- is imposed on the petitioner which is to be paid before the Rent Controller. Only on deposit of the Rent Controller shall proceed further in the matter.
