Notice of motion.
On the asking of the Court, Mr. J.S.Chandail, Additional Advocate General, Haryana accepts notice on behalf of the State.
Learned counsel for the appellants points out that the indicated RFA No.331 of 2007 and other connected RFAs have already been remanded to the learned Trial Court for a fresh decision. The remand order dated 26.02.2009 had been passed by a Coordinate Bench of this Court ( Rajesh Bindal, J.) in RFA No.331 of 2007.
On consensual basis, the matter is remanded to the learned Trial Court for a decision afresh in the light of the orders passed by a Coordinate Bench of this Court (Rajesh Bindal, J.) in RFA No.331 of 2007. It is the learned Trial Court only which shall deal with the application to bring the LRs of deceased on record.
Disposed of accordingly.
