By filing instant appeal under Clause X of the letters patent, petitioner has laid challenge to order dated 20.2.2009 passed by learned Single Judge.
Respondent No.4-Meer Singh has been recommended for appointment to the post of Lambardar on the death of his father Bishamber, who was also a Lambardar. The appointment of Meer Singh-respondent No.4 has been found to be in order by all authorities including Collector, Commissioner and the Financial Commissioner. Even the learned Single Judge has not found any ground to non-suit respondent No.4. Although some allegation with regard to default in making payment of bank loan by father of respondent No.4 was made, however, no evidence on record was
LPA No.602 of 2009(O&M) #2# found and learned Single Judge has also observed that even the default committed by his father cannot be made the basis to non-suit respondent No.4-Meer Singh. There is no ground to interfere to appointment of respondent No.4.
Accordingly, appeal fails and the same is dismissed.
