Vide this order, FAO Nos.3120, 3121, 3122, 3123 of 2006 are ordered to be transferred to the Court of jurisdiction.

These appeals are against the judgment and decree dated 24-02-2006 passed by Civil Judge (Senior Division), Patiala, vide which the applications under Sections 14, 30 and 33 of the Arbitration Act, 1940, have been allowed and the award dated 21-11-2000 has been made rule of the Court.

Learned counsel for the parties have placed on record the notification dated 18-10-2006, vide which, the Section 39 of the Punjab Courts Act 6 of 1918, has been amended. In view of the amendment vide Punjab Act 29 of 2006, the appeals from a decree or order of a Civil Judge (Senior Division) and Civil Judge (Junior Division) shall lie to the District Judge, irrespective of the value of the original suit and accordingly, in view of the amended Sub-Section 4 of Section 39, all appeals from a decree or

order of a Civil Judge (Senior Division) and Civil Judge (Junior Division), pending in the High Court, shall be transferred to the District Judge.

Accordingly, all these appeals against the Order dated 24-02-2006, passed by Civil Judge (Senior Division) Patiala, stand transferred to the Court of District Judge, Patiala, for adjudication.

Parties are directed to appear, in person, or through their counsel before the District Judge, Patiala, on 07-10-2009.
