Pursuant to the advertisement issued by respondent no.2 for recruitment to the post of Constable (General Duty) in I.T.B.P in the year 2007, the petitioner applied for the said post. He participated in the physical test. Petitioner was subjected to the physical test but found medically unfit on 9.7.2007 due to 'knocked knees'. The petitioner approached the S.M.S. Hospital and Medical College, Rajasthan and got himself medically examined and the examining doctor found the petitioner physically fit as per the Certificate dated 17.7.2007 (Annexure P-3). It is alleged that even though, petitioner was asked to appear for re-medical examination vide communication dated 13.9.2007 (Annexure P-4). However, when the petitioner approached for re-medical examination on 29.9.2007 at Military Base Hospital Indo Tibet Border Police Tigri, New Delhi, he was not examined. The petitioner has accordingly filed this petition.

In the reply filed, it is specifically mentioned in para 6 that the petitioner was medically examined at the Base Hospital, I.T.B.P Tigri Camp. Be that as it may, Mr. Sharma, learned counsel for the respondents has offered for another re-medical examination of the petitioner at the Command Hospital, Chandi Mandir, Panchkula.
In view of the above statement, this petition is disposed of with a direction to the petitioner to appear at the Command Hospital, Chandi Mandir, Panchkula for re-medical examination along with all his documents including the previous medical examination, conducted by the I.T.B.P as also the Civil Hospital, on 14.9.2009 at 10.00 A.M. Mr. Sharma will ensure that the re-medical examination of the petitioner is conducted by the Orthopaedician in the said hospital.
The claim of the petitioner for recruitment shall depend upon the outcome of the medical examination.
Disposed of as such.
