Learned counsel for the petitioner states that in this case order Annexure P/5 passed by respondent no. 2 Deputy Commissioner exercising the power of Commissioner has been challenged. By the said order, respondent no. 2 directed the Collector to continue with the proceedings initiated by respondent no. 1 Nagar Panchayat against the petitioner under the Punjab Public Premises and Land (Eviction and Rent Recovery) Act, 1973. Now it is admitted position that pursuant to impugned order Annexure P/5, Collector has passed eviction order against the petitioner and the said order has been affirmed by the Commissioner and the petitioner has already challenged the same by filing separate writ petition which has been returned with some objections and would be refiled after removal of objections.

In view of the aforesaid, learned counsel for the petitioner seeks permission to withdraw the instant writ petition without prejudice to the rights and claims of the petitioner and with liberty to him to pursue the aforesaid fresh writ petition filed to challenge the eviction orders by raising all pleas as may be permissible in law.
Dismissed as withdrawn with liberty as aforesaid.
