(Annexure P-24), a decision in principle has been
taken to the effect that SPOs may be recruited in
Punjab Home Guards as Punjab Home Guard
Volunteers. Conditions as required by law,
however, have not been specified. Repeated

representations have been made including by way
of Annexure P-25, however, no decision has been
taken thereon.

Learned counsel contends that the
petitioners have been asked to join as Home

Guards. Without giving out the conditions on
which the petitioners are being asked to join,

rights of the petitioners cannot be settled. It
would otherwise be inequitable to allow persons
to join although there are statutory rules
governing the issue.

Learned counsel further contends

that the petitioners would be satisfied if a
decision on representation, Annexure P-25 is
taken and conveyed to the petitioners.

Considering the nature of issue, I

am of the considered opinion that the petitioners
have a right to response from the respondents on
representation, Annexure P-25.

In view of the above, the petition
is disposed of with direction to the respondents
to take a decision on representation, Annexure
P-25 and convey the same to the petitioners,
within two months of receipt of a certified copy
of the order.
