This Civil Writ Petition seeks quashing of the orderscum-judgments dated 05.06.2008 (Annexure P-4) and 31.10.2008 (Annexure P-6), whereby the Defence Estate Officer, Ambala Circle, Ambala Cantt. has ordered the petitioner's eviction from the part of Bungalow No. 65 (Part-I back portion), Napier Road, Ambala Cantt., and the said order has been upheld by the Appellate Authority.
After arguing the case at some length, learned counsel for the petitioner submits that he does not want to press this writ petition on merits and would be satisfied if, subject to furnishing an undertaking, this Court may grant some reasonable time to vacate the premises. He further submits that the premises in dispute has already been sealed by the respondents and in case this Court grants some time to vacate the same, the petitioner does not want to press this petition on merits.

Having heard learned counsel for the petitioner and keeping in view the reasonable prayer made by him, this writ petition is disposed of as not pressed. However, the respondents are directed to unseal the premises in dispute after the petitioner files an undertaking before this Court within two days that he would vacate the premises voluntarily within three months from the date the premises are unsealed and hand over the peaceful vacant possession thereof to respondent No.4.
Disposed of.
Copy of this order be given dasti on payment of usual
charges.
