Counsel for the petitioner has drawn my attention to order passed by this Court vide Annexure P3 wherein the trial Court was directed to conclude the trial within six months from the receipt of order. Counsel further states that vide Annexure P2, the Sessions Judge, Bhiwani, has stated that the Additional Sessions Judge, Fast Track Court, is not competent to try offence under Section 304-B IPC. Therefore, the trial has been held up.

Counsel for the petitioner has prayed that since the trial is not proceeding, petitioner be granted bail.

In the facts and circumstances of the case, file of case arising out of FIR No. 127 dated 25.3.2008 registered at Police Station Sadar, Bhiwani, under Sections 306/34 IPC, is withdrawn from the Court of

Additional Sessions Judge, Fast Track Court, Bhiwani and same is entrusted to the Sessions Judge, Bhiwani. The Sessions Judge, Bhiwani, may himself try the case or assign the case to any other Additional Sessions Judge, who is competent to try the case.

The trial Court in pursuance of order dated 27.1.2009 passed

by this Court in Criminal Misc. No. M-1590 of 2008 is directed to conclude the trial within six months.

With the observations made above, the present petition is disposed off.
