The present petition has been preferred under Section 438 read with Section 482 Cr.P.C. seeking pre-arrest bail to the petitioners in case FIR No. 5 dated 13.1.2009 Police Station Chandhut, District Faridabad, under Sections 148, 149, 323, 324, & 452 IPC.

On 20.3.2009, this Court had passed the following order:-

“Counsel for the petitioners submits that injuries caused in the occurrence are simple in nature. Ram Pal son of Deep Chand has given pharsa blow on the right arm, Ved Parkash son of Ram Chand gave a lathi blow on the right ankle of

the complainant. Counsel further submits that petitioners are sought to be implicated in case FIR No. 5 dated 13.1.2009 registered at Police Station Chandhut under Sections 148, 149, 323, 324, 452 IPC but earlier, FIR bearing No.4 dated 13.1.2009 was lodged at the instance of petitioners against the complainant under Sections 148, 149, 323, 452 & 506 IPC. Counsel further submits that petitioners received many injuries and they were medicolegally examined at General Hospital on the same day of occurrence. It is submitted that this is a case of cross-version.

Issue notice of motion to learned Advocate General, Haryana, for 27.3.2009.

Meanwhile, in the event of arrest, petitioners shall be released on interim bail to the satisfaction of the Arresting Officer. Petitioners shall join investigation as and when called for. Petitioners shall also abide by the conditions specified under Section 438(2) Cr.P.C.”

Counsel for the State stated that petitioners have joined investigation and they are no longer required for custodial interrogation.

In view of the statement made by counsel for the State and order dated 20.3.2009 passed by this Court, interim pre-arrest bail granted to the petitioners is affirmed till filing of the report under Section 173 Cr.P.C. On submission of report under Section 173 Cr.P.C.

petitioners shall furnish regular bail-bonds to the satisfaction of the Court concerned.
