The present petitioners are the accused in case FIR No. 347 dated 12.10.2008, under Sections 323, 452, 325, 506 read with Section 34 IPC, Police Station Samlkha. They filed an application before the trial court for re-medical examination of injured Rinku for obtaining the opinion as to the nature of the injury from the Board of Doctors. Their application has been dismissed on 25.11.2008. Hence this petition.
This Court on 1.12.2008 while issuing notice of motion, also directed that the injured Rinku would be examined by the Board of Doctors to be constituted by the Civil Surgeon, Panipat. In pursuance of the said order, Rinku was examined by the Board and submitted the report.
In view of the said report, learned counsel for the petitioner, in all fairness, contends that the present petition has rendered infructuous and the same be dismissed as such.
It is ordered accordingly. However, if the State or the complainant has any objection to the report of Doctor, they can rake up the same before the appropriate forum and stage, as per law.
