This petition has been moved by Joginder Singh, under Section 482 of Cr.P.C. read with Section 3(1) (b) of the Punjab Good Conduct Prisoners ( Temporary Release) Act, 1962, seeking emergency parole for four weeks to celebrate the marriage ceremonies of his son to be soleminized on 19/20^th February 2009.

Reply filed by State is taken on record. In paragraph No.4 of the same, it has been mentioned “that on receiving a copy of petition through office of SSP, Kapurthala on 13.02.2009, an official of this office was deputed to ascertain truth about the marriage of son of the petitioner. On verification from the Gram Panchayat and Marriage card, it is found correct that the marriage of his son Sukhwinder Singh is fixed for 19/20^th February 2009”.

As averred in the petition, the petitioner was arrested in a case F.I.R.No.216 dated 25.11.1987 for the offences punishable under sections

15/61/85 of N.D.P.S.Act and was convicted and sentenced by the learned Additional Session Judge, Kapurthala.

I have heard the counsels for the parties.

This petition is disposed of with a direction to the respondents that the petitioner shall be released on parole in view of the provision of Section 3(1)(b) of the Punjab Good Conduct Prisoners (Temporary Release) Act, 1962, for a period of two weeks from the date of his release, subject to the satisfaction of District Magistrate, Kapurthala, who shall take an adequate surety before releasing him under the rules. After expiry of the abovesaid parole period, the petitioner shall surrender before the Superintendent, District Jail, Kapurthala-Respondent No.2.
