In view of nature of allegations against the petitioner and disputed question being involved whether Harbhajan Singh had actually received a sum of Rs.3000/- for which the petitioner in the capacity as Sarpanch did not issued a receipt, can now be determined on the basis of appreciation of evidence.
It will be open to the petitioner to rely upon the enquiry report dated 19.12.2007 exonerating the petitioner of the allegations of the subject matter of FIR can be produced by the petitioner in defence.
This petition is disposed of with a direction to the trial Court that the entire trial will be completed within a period three months after the next date of hearing, by giving short dates. Prima facie it is a debatable question whether the petitioner had actually received the money or prepared false documents.
