Learned counsel for the petitioner, inter alia, submits the injury attributed to the petitioner is simple in nature. He further submits that pursuant to the order dated 18.9.2009 & 12.10.2009, petitioner has joined the investigation.
Learned counsel for the State/respondent, on instructions received from HC Jagroop Singh, admits that petitioner has joined the investigation and is no more required for custodial interrogation.
In view of the above, order dated 18.9.2009 is hereby made absolute.
It is directed that the petitioner shall abide by the conditions as envisaged by Section 438(2) Cr.P.C.
