Without expression of any opinion whether in view of the provisions of Section 82(4) Cr.P.C, the petitioner could be declared a proclaimed offender as has been done vide order dated 9.8.2008, it is sufficient to observe that the petitioner was not in India at the time when the case registered against him.
Pursuant to the interim orders passed by this Court petitioner has already put in appearance before the trial Court, as such the petition has become infructuous. Petitioner will remain on bail till presentation of supplementry challan against him. He will be required to furnish fresh bail bonds to the satisfaction of the Court concerned, in case of presentation of challan/supplementry challan against him.
Petition is disposed of with the above observations.
