Dinesh Vs State of Haryana

Petitioners have brought the aforesaid petitions under section 439 of Code of Criminal Procedure for seeking regular bail in one and the same FIR No. 470 dated 20.9.2008 under sections 148, 149, 224, 225, 307, 332, 353, 511, 216, 120-B IPC and under sections 25, 54, 59 of the Arms Act registered at Police Station City Ballabhgarh District Faridabad and therefore, both the petitions are being disposed of by this common order.

Learned counsel for the petitioners contend that none of the petitioners is alleged to have caused any injury. Moreover, they both were empty handed at the time of alleged occurrence. The main accused namely Surli who is alleged to have caused fire arm injury is already in custody. It

is further contended that with similar allegations, co-accused Anoop has already been granted bail by this Court vide order dated March 30, 2009 passed in Criminal Misc.-M No. 6690 of 2009.

Taking into consideration the aforesaid facts and circumstances and without commenting on the merits of the case, both the petitioners are ordered to be released on bail on their furnishing bail/surety bonds to the satisfaction of the trial court/Chief Judicial Magistrate, Faridabad.

Both the Criminal Misc. petitions are disposed of.
