Learned counsel for the petitioner submits that only role attributed to the petitioner in the FIR is what he was armed with a pistol but no injury has been attributed to him. He further submits that co-accused, to whom injuries have been attributed, have been granted the concession of anticipatory bail. He has referred to order passed in Crl. Misc. No. M- 26381 of 2008.
Learned counsel for the State (on instructions from ASI Resham Singh, who is present in Court) submits that pursuant to order dated 01.05.2009, the petitioner has joined the investigation and is no longer required for custodial interrogation.
In view of this, the instant petition is allowed. The petitioner is granted the concession of anticipatory bail subject to the conditions as envisaged under Section 438(2) Cr.P.C.
