This revision petition is directed against the order dated 30.9.2009 passed by the Rent Controller, Karnal, whereby evidence of the petitioner-tenant has been closed by the order of the Court.
It is contended that the petitioner-tenant could not bring all the witnesses on 13.9.2009 as his counsel was bed ridden on account of slipdisc.
Having heard learned counsel for the petitioner and considering the fact that issuance of notice of motion would further delay the proceedings as the case is now fixed for 16.10.2009 before the Rent Controller, Karnal, this revision petition is allowed and the Rent

Controller, Karnal is directed that if the petitioner produces all the witnesses on the date fixed i.e. 16.10.2009, let their statements be recorded on that day subject to further payment of costs of Rs.2000/-, by the petitioner to the respondent.
Let a copy of this order be given dasti to the learned counsel for the petitioner under the signatures of the Bench Secretary of the Court
on payment of usual charges of dasti fee.
